Un juicio al estilo estalinista en la Isla “Paraíso”

El 30 de septiembre de 2013 Gorki junto a Renay fueron detenidos cuando se dirigían a la fiesta de unos amigos. La policía le encontró a Gorki dos pastillas de una medicina para la epilepsia, enfermedad que sufre desde que era un adolescente. Pasó dos días en prisión sin su medicina, cuando finalmente lo excarcelaron, las autoridades le presentaron cargos formales de tenencia ilícita de drogas. Fue ese día que comenzó la larga pesadilla.

Los medicamentos fueron recetados por un doctor mexicano durante la visita de Gorki a su hermana en Veracruz. El proceso de preparación del expediente acusatorio tomó dos meses. La familia de Gorki en México logró una declaración del médico que recetó el medicamento, pero este documento no fue suficiente. La declaración tenía que estar notariada, pero para presentarla en Cuba tiene que estar legalizada por el Ministro de Relaciones Exteriores de México. Esto ocurre porque Cuba es uno de los pocos países del mundo que nunca ha firmado el Convenio de La Haya suprimiendo la exigencia de legalización de documentos públicos extranjeros la cual facilita y acelera la legalización de documentos que han de ser usados fuera del país que los expide. Gracias a la ayuda de algunas organizaciones internacionales, la familia de Gorky consiguió el dinero y el asesoramiento legal necesarios para obtenerla.

Aún la legalización acuñada por el Ministerio de Relaciones Exteriores de México no es suficiente para la fiscalía cubana. Lo próximo fue que los documentos tenían que ser presentados en el consulado cubano en México que pudiera declarar, de acuerdo a las palabras de Gorki, ¨que ese doctor y ese notario, y que el Ministerio y finalmente un país llamado México existían¨. Los documentos llegaron a La Habana en un paquete de mensajería que había sido abierto previamente por las autoridades.

Gorki no tiene acceso a internet en su vivienda. El usa la red en una de las embajadas europeas. Su día para conectarse al internet es cada lunes cerca de las 2:00 PM, hora local. Sin embargo, desde las Navidades hasta mediados de enero la mayoría de las embajadas permanecieron cerradas.  Cuando hablamos la última vez en la segunda mitad de diciembre de 2013, Gorki aún no tenía idea ni del contenido preciso de las acusaciones que le imputaban ni del posible día del juicio.

El 10 de diciembre es el Día Internacional de los Derechos Humanos. En esa ocasión la organización cubana Estado de Sats dirigida por Antonio Rodiles, preparó una serie de reuniones y presentaciones de algunos excelentes cubanos intelectuales, disidentes y artistas. Las actividades fueron planeadas para los días 10 y 11 de diciembre. El 10 de diciembre comenzaron los arrestos. Entre los detenidos se encontraba el arriba mencionado Antonio Rodiles. En la tarde recibí un mensaje de texto de Gorki “estamos bien solo preocupados por Rodiles”. Gorki fue a su casa para unirse a las demás personas
que protestaban contra los arrestos. Fue detenido por dos policías vestidos de civil y fue golpeado brutalmente (recibió golpes en la cabeza que le causaron un ataque de migraña). Permaneció arrestado durante dos días. Me informaron de este incidente en una larga declaración enviada por correo electrónico de parte de Ciro Díaz.

A fines de enero Gorki pudo volver a conectarse a internet. Hablamos de los planes para el año, los posibles conciertos en Europa, el nuevo material que estaba creando con Porno para Ricardo y un
proyecto musical completamente nuevo que se anunciaría a mitad de año. Discutimos acerca de las cámaras instaladas frente a las viviendas de los disidentes para espiarlos (la que le instalaron a Gorki fue una de las primeras).

El 31 de enero recibí otra declaración larga por correo electrónico de parte de Ciro diciendo que Gorki había recibido una notificación con la fecha del juicio: febrero 11. Decidí no preocuparme mucho. La idea de incriminar a un hombre enfermo por culpa de su enfermedad y el hecho de que él está tratando de tener una vida normal era para mí, alguien que vive en un país normal y democrático, tan absurda que tenía dificultad creyéndola. Además, ya sabía que toda la documentación médica estaba ya completa. Pero la peor noticia estaba por llegar. Un “juicio sumario” que es el tipo de juicio que tendrá Gorki no es más que una copia al carbón de los juicios de la Rusia de Stalin en los años treinta del siglo pasado que eran básicamente una farsa. La defensa no puede tener acceso a los archivos de la fiscalía, lo que hace imposible preparar una defensa apropiada. En esas condiciones podemos decir que Gorki ya había sido hallado culpable. Si es sentenciado, y si ocurriera lo peor, por cuanto tiempo, es un asunto que sólo le interesa a la comunidad internacional.

Durante la pasada semana he visto muchos gestos de solidaridad, ayuda y apoyo. Muchas personas han firmado la petición dirigida a las autoridades cubanas de que le quiten los absurdos cargos a Gorki (aunque no sabemos exactamente cuáles son las acusaciones). Activistas han estado enviando
fotos y videos mostrando su apoyo, y han compartido cada información sobre el caso.  Gorki mismo ha grabado un video que contiene su declaración sobre el juicio y un llamado para que se solidaricen. Gorki trata de estar calmado pero cualquiera que lo conoce un poco sabe que está asustado. Ya esto no es un mal chiste. Si este hombre de 45 años (a muchos se nos olvida que ya no es un adolescente) termina en la prisión sin la posibilidad de continuar sus terapias, este caso puede terminar en una tragedia. No sabemos si cuando pase lo peor, podremos sacarlo de allí antes de que los ataques epilépticos hagan su trabajo.

Vamos a movilizarnos. Tenemos tres días hasta el juicio. Mostremos a las autoridades cubanas que estamos siguiendo de cerca sus acciones y que una enfermedad y “canciones prohibidas” no es una razón suficiente para condenar a un hombre a una posible muerte. Gorki no ha hecho nada malo. Él solamente canta y habla lo que piensa en voz alta. Y es una persona positiva que usa bromas, palabras cariñosas para cualquier persona, con su risa y su buena energía. Es difícil creer que este muchacho quien siempre trata de que todo el mundo alrededor de él haga el amor, quien trata de seducer cada muchacha que le gusta y quien se pasa la vida bromeando con todas las personas, muchas veces a pesar de las barreras del lenguaje, vaya a ser castigado por el simple hecho de que tiene el coraje de pensar por sí mismo... pero es la realidad. Y depende de nuestra solidaridad si logra salir de esta opresión.

A STALIN-STYLE SHOW TRIAL ON THE „PARADISE” ISLAND


On September 30th 2013 Gorki along with Renay were stopped while going to their friends’ party. The
police found on Gorki two pills of a medication for epilepsy which Gorki has been suffering from since he was a teenager. He spent two days in prison without his medication. When he was finally freed, he was presented with the charges of illegal possession of controlled drugs. It was that day when the
months long nightmare started.

Medications were prescribed by a Mexican doctor during Gorki’s visit at his sisters’ in Veracruz.
The procedure of the preparation of documents took two months. Gorki’s family in Mexico managed to get the statement of the doctor who prescribed the medication. But such a paper was not enough. The statement had to be confirmed by a notary. But to present it in Cuba it had to be fully legalized by the
Mexican Ministry of Foreign Affairs. And that is because Cuba is one of a very few countries of the world which has never signed the Hague convention on the international “apostille” standard which makes it easier and faster to legalize the documents which are to be used outside the issuing country. Thanks to the help of a few international organizations Gorki’s family got the money and necessary legal advice to obtain it.

Still even the legalization granted by the Mexican Ministry of Foreign Affairs is not enough for the Cuban courts. So next the documents had to be presented in the Cuban consulate in Mexico so that it could declare, according to Gorki’s words that “there exists such doctor and notary and the Foreign Affairs Ministry and finally such a country called Mexico”. Documents arrived to Havana in a courier
package which had been opened by the authorities.

Gorki has no fixed internet connection. He uses a network in one of the European embassies. His
day is Monday around 2:00 p.m. local time. But since Christmas up to mid January most of the embassies stayed closed. When we talked for the last time in the second half of December 2013, Gorki still had no clue neither about the precise content of the charges that were to be pressed against him or about the possible date of the trial.

December 10th is International Human Rights Day. On that occasion the Cuban organization Estado de Sats led by Antonio Rodiles, prepared a set of meetings and presentations of some excellent
Cuban intellectuals, dissidents and artists. The celebrations were planned for December 10th through the 11th. On December 10th the arrests started. Among others detained was the above mentioned Antonio Rodiles. In the afternoon I received a text message from Gorki “we’re fine just worried about Rodiles”. Gorki went to his house to join the others who protested against the arrests. He was stopped by two policemen in civil clothes and beat up brutally (he received a few punches on the head which ended up causing a migraine attack). He was kept in jail for another two days. I was informed about this incident in a one sentence long e-mail from Ciro Diaz.

In the end of January Gorki got back online. We talked about the plans for the upcoming year,
the eventual concerts in Europe, the new material he was creating with Porno para Ricardo and a completely new musical project he is about to announce in the middle of the year. We discussed new urban cameras installed in front of the dissidents’ houses (Gorki had “his” installed as one of the first).

On January 31st I received another one sentence long email from Ciro saying that Gorki had received the note with the date of the trial – February 11th. I decided not to worry too much. The idea of -incriminating a sick man just for his sickness and the fact that he is trying to have a normal life – alone was for me, a person who lives in a normal, democratic country, so absurd that I had difficulty with believing in its’ reality. According to this I already knew that the whole medical documentation was already completed. But the worst information was just about to hit. In a “Juicio sumario” (summary trial) as the type of trial Gorki will have to go through is nothing more than a copy of trials held in Stalin’s Russia in the thirties of the last century which were basically a show. The defense is not allowed access to the prosecution files, which makes it impossible to prepare the proper line
of defense. In those terms we can say that Gorki was already found guilty. If he is sentenced, and if it comes to the worst – for how long, is just a matter of the interest of the international community.

During last week I observed plenty of gestures of solidarity, help and support. Many people have
signed the petition to the Cuban authorities for clearing Gorki of the absurd charges (though we do not exactly know what their accusations are). Activists have been sending pictures and videos showing their support, they have been sharing each and every single piece of information. Gorki himself has recorded a video containing his statement about the trial and a call for support. He tries to stay calm and cool but anyone who knows him even just a bit can see that Gorki is scared. It is not just a bad joke anymore. If this forty-five year old man (many of us tend to forget that he is not a teenager anymore) ends up in jail without the possibility to continue his therapy, this case may come to the most tragic end. We do not know if when the worst come to worst, we will be able to get him out of there before the epilepsy will do its’ job…

So let’s move. We have three days left until the trial. Let’s show the Cuban authorities that we watch their actions closely and that illness and “forbidden songs” are not reason enough to sentence a man to possible death. Gorki has done nothing wrong. He just sings and speaks his mind out loud. And he carries all the positives -his jokes, good word for everyone, laughter, good energy. It is truly hard to believe that this guy who always tries to make everyone around him have sex, who tries to seduce each and every girl he likes and who keeps on joking with everyone – sometimes despite the language barriers - might be punished for the simple fact that he has the bravery of thinking by himself…

But it is real. And it is only up to our solidarity if he makes it out of this oppression.

STALINOWSKA POKAZÓWKA NA „RAJSKIEJ” WYSPIE


Wieczorem 30 września 2013 roku Gorkiego wraz z Renayem zatrzymano, gdy szli na imprezę do znajomych. Znaleziono przy nim dwie tabletki leku na epilepsję, na którą Gorki choruje od czasu szkoły średniej. Spędził w więzieniu dwa dni bez lekarstw. Gdy wychodził, usłyszał zarzuty nielegalnego posiadania substancji kontrolowanych. Tego dnia rozpoczęła się wielomiesięczna gehenna.

Leki zostały przepisane przez meksykańskiego lekarza podczas pobytu Gorkiego u jego siostry w Veracruz. Recepta została oczywiście w aptece podczas zakupu. Dwa miesiące trwała procedura przygotowania dokumentów. Rodzina Gorkiego w Meksyku zdobyła zaświadczenie od lekarza, który leki przepisał. Jednak taki dokument nie był wystarczający. Zaświadczenie musiało zostać poświadczone notarialnie. Aby przedstawić je na Kubie należało dokonać pełnej „legalizacji” dokumentu w Ministerstwie Spraw Zagranicznych Meksyku. Kuba jest bowiem jednym z niewielu krajów na świecie, które nie podpisały konwencji haskiej dotyczącej międzynarodowego standardu „apostille”, dzięki któremu dokumenty przeznaczone do przedstawienia poza granicami kraju, który je wystawił mogą zostać „zalegalizowane” szybciej i taniej. Dzięki pomocy kilku organizacji międzynarodowych udało się zdobyć pięniądze i niezbędne konsultacje prawne.

Jednak nawet poświadczenie przez Ministerstwo Spraw Zagranicznych Meksyku nie jest wystarczające dla kubańskich sądów. Zatem dokumenty należało następnie przedstawić w konsulacie kubańskim w Meksyku, aby ten potwierdził, zgodnie ze słowami Gorkiego „że istnieje taki lekarz, notariusz, Ministwerstwo, a w końcu państwo Meksyk”. Zaświadczenia dotarły do Hawany w otwartej przez służby przesyłce kurierskiej.
Gorki nie ma stałego dostępu do internetu. Korzysta z łącza udostępnianego w jednej z ambasad europejskich. Jego dzień to poniedziałek, w okolicach 14:00 czasu lokalnego. Jednak na okres świąt i do połowy Stycznia większość ambasad jest zamykana. Gdy rozmawialiśmy po raz ostatni, w drugiej połowie grudnia 2013 roku, Gorki nadal nie znał dokładnej treści zarzutów, które usłyszy przed sądem, ani nawet przybliżonej daty procesu.

11 grudnia jest Międzynarodowym Dniem Praw Człowieka. Z tej okazji niezależna kubańska organizacja Estado de Sats, której liderem jest Antonio Rodilles, przygotowała cykl prezentacji i spotkań, w których uczestniczyć mieli najwybitniejsi intelektualiści, opozycjoniści i artyści. Obchody zaplanowano na kilka dni. 10 grudnia rozpoczęły się aresztowania. Zatrzymano między innymi wspomnianego Antonio Rodillesa. Po południu dostalam smsa „u nas wszytko dobrze, martwimy się Rodillesem”. Gorki udał się pod jego dom, aby wraz z innymi prostestować przeciwko aresztowaniom. Został zatrzymany przez policjantów w cywilnych ubraniach i brutalnie pobity (otrzymał kilka ciosów w głowę, co skończyło się atakiem migreny). Znowu siedział dwa dni. Informację tym incydencie dostałam w jednozdaniowym mailu od Ciro Diaza.
Pod koniec stycznia Gorki wrócił online. Rozmawialiśmy o planach na przyszły rok, ewentualnych koncertach w Europie, o nowym materiale, który tworzy wraz z Porno para Ricardo i osobnym projekcie muzycznym, który ma ujrzeć światło dzienne w połowie roku. Dyskutowaliśmy o kolejnych kamerach instalowanych przed domami opozycjonistów (Gorki miał „swoją” przed domem jako jeden z pierwszych).

31 Stycznia znów dostałam jednozdaniowego maila od Cira „Gorki ma datę procesu – 11 lutego”. Postanowiłam się nie martwić. Sam pomysł stawiania przed sądem chorego człowieka za to, że się leczy i po prostu próbuje żyć normalnie, jest dla mnie, osoby żyjącej w wolnym i demokratycznym świecie, tak absurdalny, że ciężko mi uwierzyć w jego realność. Wiedziałam ponadto, że dokumentacja jego choroby i leczenia jest już skompletowana. Jednak najgorsza informacja uderzyła kilka dni później. „Jucio sumario” – bo tak określany jest proces podczas którego Gorki będzie sądzony – to wzorowana na stalinowskich rozprawach z lat trzydziestych ubiegłego wieku pokazówka. Obrona nie otrzymuje dostępu do aktu oskarżenia, nie ma zatem szans na przygotwanie linii obrony. Gorki został już uznany za winnego. Czy zostanie skazany i jeśli sprawy przybiorą fatalny obrót – na ile – zależy wyłącznie od zanteresowania sprawą społeczności międzynarodowej.

W ciągu ostatniego tygodnia obserwowałam wiele aktów solidarności, bezinteresownej pomocy i wsparcia. Wiele osób podpisuje petycję do władz kubańskich w sprawie oczyszczenia Gorkiego z zarzutów (choć nawet ich naprawdę nie znamy). Działacze przesyłają zdjęcia i filmy ze słowami poparcia, dzielą się informacjami. Sam Gorki nagrał video z oświadczeniem o swoim procesie i prośbą o wsparcie. Próbuje zachować swobodę, ale każdy, kto zna go choć trochę, od razu zauważy, że Gorki się boi. To nie przelewki. A jeśli ten czterdziestopięcioletni facet (wielu z nas zapomina, że Gorki nie jest już nastolatkiem)  trafi do więzienia, bez możliwości kontunowania leczenia, ta sprawa może zakończyć się tragicznie. Bo nie wiadomo, czy nasza solidarność sprawi, że uda się go stamtąd wydobyć zanim epilepsja zrobi swoje...

Zmoblilizujmy się zatem. Do procesu zostały ledwie trzy dni. Pokażmy kubańskim władzom, że patrzymy im na ręce. Że choroba i „zakazane piosenki” to niewystarczający powód, aby wydawać na człowieka wyrok możliwej śmierci. Gorki nie zrobił nic złego. On tylko śpiewa i głośno mówi, co myśli. A poza tym przecież niesie z sobą zawsze same pozytywy – żarty, dobre słowo, śmiech, pozytywną energię. Ciężko mi uwierzyć, że ten facet, który wszystkich dookoła wkółko namawia do uprawiania seksu, kokietuje każdą dziewczynę, na której zawiesi wzrok, żartuje z każdym napotkanym człowiekiem czasem mimo bariery językowej, ma ponieśc karę tylko za to, że ma odwagę myśleć po swojemu… Niestety taka jest reczywistość. I tylko od naszej solidarności zależy, czy uda mu się wyjść z tej opresji cało.
